Business operations at overseas offices are becoming increasingly important, and the efficient minimization of legal risks associated with overseas operations is one of the key areas in which management skills are tested. The reason for this is that, although it is difficult to identify legal risks associated with overseas sites, the materialization of such risks will not only have a negative impact on a company’s reputation but there is also a risk that the Japanese parent organization will be held legally responsible.
An increasing number of Japanese companies have developed global whistleblowing systems as a means to identify overseas legal risks, and it is necessary to update such systems in response to the relevant legislative trends, such as the establishment of the EU Whistleblowing Directive and China’s Personal Information Protection Law.
In this webinar, lecturers will provide commentaries on European, Chinese, Taiwanese and Korean laws relating to global whistleblower systems. In particular, regarding European law, we have invited Dr. Söpper from Rakuten Group Inc. Global Privacy Office, who holds a German lawyer qualification, as a guest speaker to talk about the company’s privacy-related practical experiences.

Fumiaki Matsuoka, Partner (Daiichi Tokyo Bar Association)
Graduated from Kyoto University (LL.B.) in 2005. He registered as a lawyer in 2006. He provides support for Japanese companies’ responses to the General Data Protection Regulation (GDPR), the Act on the Protection of Personal Information in Japan, China’s Personal Information Protection Law, and other data protection matters. Co-author of “Research Study on Recent Trends of Data Protection Acts in Other Countries,” Personal Information Protection Commission(2018). Feng Qin Chen, Of Counsel (Admitted in the PRC)
Graduated from Peking University (LL.B.) in 2000, and registered as a lawyer in the People’s Republic of China (not registered as a Foreign Lawyer in Japan). She has worked with Japanese law firms and corporate legal departments since 2005. As a representative of Japanese companies, she provides support in all aspects of cross-border transactions, M&A and restructuring, China-related matters (including antitrust, intellectual property and labor), and protection of personal information, etc. She has handled numerous legal consultations from Chinese companies, most of which have been cross-border cases such as a Chinese company expanding to Japan. Co-author of “Research Study on Recent Trends of Data Protection Acts in Other Countries” (Personal Information Protection Commission, 2018). She is also active in holding seminars for companies in Japan and overseas.

Youngseop Song, Of Counsel (Admitted in Korea)
Graduated from Seoul National University (B.S. in Electrical Engineering) in 2007, Yonsei University School of Law (J.D.) in 2013, and University of Virginia School of Law (LL.M.) in 2020. He registered as a lawyer in Korea in 2013, state of Illinois in the U.S. in 2020, and state of New York in the U.S. in 2021 (not registered as a Foreign Lawyer in Japan). He worked with Kim & Chang, Korea’s largest law firm in Seoul for eight years. He is accomplished in supporting clients in the Internet and technology sectors with matters related to data protection, privacy law, antitrust law, M&A, e-commerce law, and the copyright law.

I-Hsien Weng, Associate (Admitted in Taiwan)
Graduated from National Taiwan University Law School (LL.B.) in 2010, and National Taiwan University Law School (LL.M.) in 2012. She registered as a lawyer in Taiwan and joined Formosa Transnational Attorneys at Law in Taipei, Taiwan in 2013 (not registered as a Foreign Lawyer in Japan). After graduating from Columbia Law School (LL.M.) in 2016, she registered as an attorney in the state of New York in 2017. She has worked with Atsumi & Sakai since 2019. In Taiwan, she represents and advises clients on all aspects of cross-border and local M&A transactions and strategic investments. She also provides legal advice in many fields such as anti-trust, labor, personal information protection, foreign investments, anti-money laundering, and consumer disputes, etc.

Yang Xu, Associate (PRC Legal Professional)
Graduated from Tsinghua University (LL.B.) in 2008, Tsinghua University (M.P.A.) in 2010, and Waseda University (Ph.D. in Economic Law) in 2016. She qualified as a PRC Legal Professional (not registered as a Foreign Lawyer in Japan) and joined a major Japanese law firm in 2015. She joined Atsumi & Sakai in 2018. Her main fields of business include M&A and restructuring, China-related matters (including antitrust, intellectual property and labor), personal information protection and privacy, and the expansion of Chinese companies to the Japanese market. She has handled numerous cases related to the protection of personal information in a wide range of industries, including the Internet, electronic products, automobiles, medical care, logistics, finance, and aviation, and has deep knowledge of regulations and practices, such as the collection, storage, utilization, and cross-border transfers of personal information of users and employees, as well as the associated safety assessments unique to China.

Dr. Pascal Söpper (Admitted in the Federal Republic of Germany)
Graduated from University of Münster in Germany in 2011 and obtained his doctorate (Ph.D.) from the same university in 2015. He registered as a lawyer in Germany in 2016 (not registered as a Foreign Lawyer in Japan). He worked as an associate professor at Niigata University from 2013 to 2016 and joined Janssen Foreign Law Joint Enterprise in 2016. He worked for Atsumi Sakai Janssen Rechtsanwaltsgesellschaft mbH (Frankfurt am Main, Germany) in 2017. In June 2018, he joined Rakuten Group Inc. (at the time, Rakuten, Inc.) and specializes in privacy matters at the Global Privacy Office.
